The BAA reflects the requirements of the Health Insurance Portability and Accountability Act and its implementing regulations at 45 C.F.R. Parts 160 and 164, including the HITECH Act.
Under the BAA, Wurkzen acts as your Business Associate when it creates, receives, maintains, or transmits Protected Health Information (PHI) on your behalf, and commits to the safeguards required by the HIPAA Security Rule.
Substance use records (42 C.F.R. Part 2). Treatment centers often handle records protected under 42 C.F.R. Part 2 and state SUD confidentiality laws. Your facility, as the covered entity, determines whether information is Specially Protected Information and is responsible for obtaining and documenting the consents, authorizations, and redisclosure rights required before making it available to the Services.
